DropCatching.co.uk provide a Software as a Service ("SaaS") domain registration solution for expired domain names managed by Nominet. These terms and conditions apply between Gueek Ltd, a company registered in England and Wales with registration number 13246799, and a client ("Client") who creates an account with an email address and password for the purposes of accessing the SaaS.
1. Definitions
For the purpose of these Terms and Conditions, the terms within this agreement shall have the meanings defined below.
1.1 "Service Fees" means the charges generated each time a domain name is caught using our SaaS. Charges can vary depending on your Plan and are defined within the SaaS. Service Fees are calculated monthly in arrears and will produce an invoice for payment within your Account.
1.2 "SaaS" means our domain registration solution software provided as a web service that is based upon Gueek Ltd's proprietary software and provisioned as a service by Gueek Ltd. The Client can access the SaaS using a web browser.
1.3 "Services" means the hosting, maintenance, support and other services provided by Gueek Ltd pursuant to these Terms and Conditions.
1.4 "Client" means an individual (who may or may not be requesting we provision services on behalf of an organisation) who creates an account with an email address and password for the purposes of accessing the SaaS. Any Client creating an account will be bound by these Terms and Conditions.
1.5 "Nominet" means Nominet UK, the official registry for UK domain names. Their principal place of business is Minerva House, Edmund Halley Road, Oxford Science Park, Oxford, OX4 4DQ.
1.6 "DAC" means Nominet UK's Domain Availability Checker, a service which allows high volumes of queries regarding the availability of domain names that Nominet UK manage.
1.7 "Catch" or "Catches" means registration of an expired domain name within a short time period after the domain name has been deleted by Nominet. A short time period is usually, although not limited to, tens of milliseconds.
2. Limitations
Any Client wishing to access or use the SaaS must have an active Registrar account with Nominet, be a Nominet Member, be subscribed to DAC, add one or more IP address(es) provided by Gueek Ltd to their live EPP and DAC services at Nominet, and have one or more expired domain names that the Client wishes to attempt to Catch.

3. Service Fees
In order to access and use the SaaS, the Client is required to pay Service Fees. These fees are agreed with each Client individually and vary depending on the number of domain names successfully registered during the Client's billing cycle.
Clients are billed monthly on the Client's billing day. This day is the anniversary day on which the Client created their Account. The only exception is where the Client created an account after the 28th day of any month. In this scenario, the billing day is set to the 28th.
If Service Fees are not paid in accordance with the provisions hereof, along with any additional terms of payment communicated to Client by Gueek Ltd, all further access to the Service will be blocked without notice. Furthermore, if Service Fees remain outstanding, Gueek Ltd may delete any domain names registered linked to unpaid Service Fees.
Invoices are automatically generated within a Client Account in respect of the Service Fees. All invoices are payable within seven calendar days, unless otherwise agreed in writing. Payment will be attempted no less than 24 hours after invoice date. Payment will be taken using Billing Details provided by Client.
4. Nominet Fees
When a Client Catches an expired domain name, it is registered via EPP to the Client's tag within their Nominet account. This action triggers Nominet to charge for registering a domain name for one year. The Client is also responsible for these fees, which are invoiced directly by Nominet to the Client.
Clients are required to have sufficient credit available within their Nominet account in order to create a chargeable transaction and therefore Catch a domain name. Should a Client not have sufficient available credit with Nominet, an EPP response code of 2104 'Billing failure' will be returned and Client notified.
5. Maintenance
Gueek Ltd and/or its hosting or telecommunications suppliers may perform system maintenance at any time. Any such maintenance will be kept to a minimum.
6. Support
Support is available via email or contact form. All support queries will be responded to within 24 hours, usually much sooner. Resolution of reproducible issues shall be according to severity and impact of users.
7. Upgrades
Gueek Ltd will deploy software upgrades/releases of the SaaS periodically, including patches and/or fixes. Upgrades will be made available at no charge to Client.
8. Acceptance
By using our Applications, you signify your acceptance to these terms and conditions. If you do not agree to these terms and conditions, you must cease using our Applications immediately. Your continued use of our Applications following the changes to these terms and conditions deems your acceptance of those changes.
